Acceptance of Terms

By accessing and using the services provided by CrystalAlluvium B.V. ("Company," "we," "us," or "our"), including our fitness facilities, website, and related services, you ("Member," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or facilities.

These Terms constitute a legally binding agreement between you and CrystalAlluvium B.V., a company registered in the Netherlands under registration number NL72836419, with its principal place of business at Berkenlaan 5, 1097 ZE Amsterdam, North Holland, Netherlands.

Description of Services

CrystalAlluvium operates a fitness centre providing various health and wellness services including but not limited to:

• Access to fitness equipment and facilities
• Personal training services
• Group fitness classes
• Nutrition coaching and counselling
• Wellness programmes and workshops
• Related health and fitness services

Membership and Registration

To use our services, you must register for membership and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Membership is personal and non-transferable. You may not share, lend, or otherwise allow others to use your membership privileges. We reserve the right to verify membership status and identity at any time.

User Obligations

As a member, you agree to:

• Comply with all facility rules, policies, and safety guidelines
• Treat staff, other members, and property with respect
• Use equipment properly and report any damage or safety concerns
• Maintain appropriate hygiene and wear suitable fitness attire
• Not engage in any illegal, harmful, or disruptive behaviour
• Follow all health and safety protocols, including emergency procedures
• Provide accurate health information relevant to your fitness activities
• Pay all fees and charges in accordance with your membership agreement

Health and Safety

You acknowledge that physical exercise and fitness activities involve inherent risks. Before beginning any fitness programme, you should consult with a healthcare professional. You participate in all activities at your own risk and assume full responsibility for any injuries or health issues that may arise.

You must disclose any relevant health conditions, injuries, or limitations that may affect your ability to safely participate in fitness activities. We reserve the right to restrict access to certain services or areas if we believe your participation poses a risk to yourself or others.

Payment Terms

Membership fees are due in advance according to your chosen payment schedule. Late payments may result in suspension of membership privileges and additional charges. We reserve the right to change membership fees with appropriate notice as required by law.

All payments are non-refundable unless otherwise specified in your membership agreement or required by applicable consumer protection laws.

Intellectual Property

All content, materials, and intellectual property associated with CrystalAlluvium, including but not limited to our name, logo, website content, training programmes, and proprietary methods, are owned by or licensed to CrystalAlluvium B.V. and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written permission. This includes but is not limited to copying workout routines, training materials, or business methods for commercial use.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, CrystalAlluvium B.V., its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of our services, including but not limited to personal injury, property damage, or loss of data.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us for services in the twelve months preceding the claim.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless CrystalAlluvium B.V. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your breach of these Terms, your use of our services, or your violation of any rights of another party.

Termination

Either party may terminate your membership in accordance with the terms of your specific membership agreement. We reserve the right to immediately terminate or suspend your membership for violation of these Terms, non-payment of fees, or behaviour that we deem harmful to our business, staff, or other members.

Upon termination, your right to access our facilities and services will immediately cease. Sections of these Terms relating to intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through our website or other appropriate means. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and you benefit from mandatory consumer protection laws of your country of residence where they provide greater protection.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes. If a dispute cannot be resolved through direct communication, you may have the right to use alternative dispute resolution mechanisms, including mediation or arbitration, as provided under applicable law.

EU residents may also use the European Commission's Online Dispute Resolution platform available at ec.europa.eu/consumers/odr.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any specific membership agreement you have signed, constitute the entire agreement between you and CrystalAlluvium B.V. regarding your use of our services and supersede all prior agreements and understandings.
